Extension of time EOT in construction contracts Construction contracts typically allow for the extension of the construction period if there is a delay that is not the contractor’s fault. This is known as a time extension (EOT).
When it becomes reasonably clear that there is, or is likely to be, a delay that could warrant an extension of time, the contractor provides written notice to the contract administrator, identifying the relevant event that has caused the delay.

EOT Claim Basic Requirements

  • Choose the Correct Programme to Impact: Is it an approved baseline, an unapproved baseline, a recovery programme, or a revised programme? Many claims fail because the claimant has an impact on the incorrect programme.
  • Address Issues of Culpability, Compensability and Concurrency: Understand and address the impact of these factors on your entitlement. Don’t avoid these issues because doing so will result in a failed claim.
  • Tell the Story: There’s a beginning, a middle, and an end! A delay claim must ultimately be a compelling storey that persuades colleagues.
  • Avoid Over Complication: All too often, too many consultants overcomplicate the entire process. The simplest solution is the best.
  • Use an Experienced Analyst: Don’t bet your team’s ability to deliver items 1 through 9 above. Employ or appoint someone with a proven track record of obtaining EOTs. This decision has the potential to make or save you a large amount of money.
